Following Senator Harsdorf’s testimony on AB 584, a proposal requiring a person arrested for or charged with certain sexual offenses, or a juvenile taken into custody for certain offenses, to provide a biological specimen for DNA testing, Representative Fred Kessler expressed his concerns about the constitutionality of this bill. He referenced Article I, Section 11, and said, “I think the Constitution is pretty clear….Wisconsin’s Constitution is pretty specific about searches.” He went on to add, “I took my oath seriously about upholding the Constitution.”
In her response, the woman who joined Harsdorf stated, “I just respectfully disagree. I think that’s why we have courts, because we have disagreements on how to interpret the Constitution. And I do believe it is constitutional.”
